France Takes Major Step Toward Legalizing Assisted Dying

New legislation could transform end-of-life care in France following a significant vote by the National Assembly.


French lawmakers have voted in favor of a bill allowing assisted dying for terminally ill patients, marking a potential shift in societal and healthcare attitudes toward end-of-life issues as the Senate prepares for further discussions.


French Members of Parliament (MPs) have made a landmark decision by voting to approve a bill that would legalize assisted dying for individuals facing the last stages of terminal illness. The National Assembly's support for the bill, which garnered 305 votes in favor compared to 199 against, reflects a significant shift in France’s approach to end-of-life issues. The proposed legislation, which has the backing of President Emmanuel Macron, will now advance to the Senate for further review before being returned to the National Assembly for a second reading. If successfully passed, it could see implementation by 2027, making France the eighth European Union country to permit some form of assisted dying.

However, the French model is expected to be more restrictive compared to more permissive laws present in the Netherlands and Belgium, which were pioneers in legalizing assisted dying. The primary focus during the assembly's extensive two-week debate was on defining the patient eligibility criteria for assisted dying. As it stands, the bill allows for assisted dying for "people struck by a serious and incurable disease" that poses a life threat and is in "advanced or terminal phases," while experiencing "constant physical or psychological suffering." Eligibility is contingent upon the patient’s ability to "freely manifest his or her intention," which must be reiterated after a 48-hour waiting period. The administration of the lethal substance is expected to be either self-administered by the patient or assisted by medical personnel if the patient is not in a condition to do so themselves, contingent upon a physician’s authorization following peer consultations.

The vote allowed MPs a free choice, highlighting the diverse opinions that transcend political lines; while lawmakers from the center and left largely supported the measure, right-wing representatives voiced strong opposition. Conservative factions, echoing sentiments from the traditionally influential Catholic Church, raised concerns about the possible broad interpretation of the bill, which they fear might permit assisted dying for individuals who might still have years of life ahead. Critics argue that vulnerable elderly individuals could be unduly pressured into ending their lives to lessen the burden on their families. During protests against the bill, a demonstrator suffering from Parkinson’s disease likened the legislation to a "loaded pistol left on my bedside table."

Conversely, some legislators on the left are advocating for broader access to assisted dying, including proposals to extend it to minors, non-nationals, and patients who have pre-emptively drafted directives before losing consciousness. Healthcare professionals who oppose assisted dying will not be mandated to participate in the procedure, yet efforts to criminalize any attempts to obstruct assisted dying were deemed necessary by conservative members but ultimately rejected in the assembly.

Macron expressed on social media that the approval of both assisted dying and a bill guaranteeing palliative care represents "an important step" towards a more compassionate policy landscape in France. Meanwhile, the debate around assisted dying is expected to continue as nuances and ethical implications of the legislation are further examined.
