South Korean Court Reinstates Prime Minister Han Duck-soo Amid Political Turmoil

The constitutional court of South Korea has overturned the impeachment of Prime Minister Han Duck-soo, reinstating him as the acting president amidst a backdrop of political instability.


Prime Minister Han Duck-soo has been reinstated by South Korea's constitutional court following the dismissal of his impeachment, which came after political unrest caused by President Yoon Suk Yeol’s suspended duties. As the nation anticipates a crucial ruling on Yoon's impeachment, analysts suggest the court’s decision aims to maintain stability during a tumultuous political phase.


South Korea's constitutional court has overturned the impeachment of Prime Minister Han Duck-soo, restoring him as the nation’s acting president. Han initially took over as acting leader in December when President Yoon Suk Yeol was suspended after his attempt to implement martial law led to his impeachment by parliament. However, Han’s tenure was short-lived; he himself was impeached two weeks after assuming office. Since that time, the country has been under the leadership of Deputy Prime Minister Choi Sang-mok.

The political landscape in South Korea has been tumultuous since Yoon's attempted declaration of martial law. Following his ascension to the role of acting president, Han blocked new judicial appointments which could have favored the opposition in seeking Yoon's impeachment, a move that ultimately led to his own impeachment. On Monday, the court ruled decisively against Han's impeachment with a seven-to-one vote, which Han expressed gratitude for, stating he would work towards restoring government order.

The ongoing political strife now centers on the constitutional court’s impending decision regarding President Yoon's impeachment, voted on by lawmakers on December 14. Should the court uphold the impeachment, Yoon would be ousted, necessitating a presidential election within 60 days. Conversely, a dismissal would enable Yoon to reclaim his presidency immediately. While the timing for this court decision remains unconfirmed, protests have surged in Seoul, showcasing deep divisions among Yoon's supporters and opponents in recent weeks.

Political analyst Leif-Eric Easley observed that the court's decision to dismiss Han's impeachment reflects a desire to uphold impartiality and encourage national stability amid ongoing political transitions. He suggested this ruling serves as a warning to progressive factions for their aggressive impeachment efforts while simultaneously preparing the stage for the more significant verdict on Yoon's future. By leaning toward conservative outcomes, the court aims to foster a sense of unity and legitimacy as it approaches its ruling on the president’s case.
